Terms and conditions.

These terms govern your use of LuneRx.com. LuneRx is a marketing and technology platform. It is not a pharmacy, not a medical practice, and not a healthcare provider. Please read this before you use the site.

SECTION 1

Accepting these terms.

These Terms and Conditions are an agreement between you and LuneRx, operated by The Piper Group ("LuneRx", "we", "us"), whose business address is 8888 W Hillsborough Ave, Tampa, FL 33615. They apply to everyone who visits LuneRx.com, submits the free eligibility check, or sends us a message through the contact form.

By using this website you accept these terms. If you do not agree with them, please do not use the site.

Our Privacy Policy is part of this agreement and describes what we collect, why, and who receives it. Read the two together.

Other agreements will also apply to you, and they are not ours. Vital Link PLLC, the independent medical group whose licensed providers conduct consultations, asks for its own telehealth informed consent and may have its own terms of service before any consultation. Logos RX, the state-licensed pharmacy that fills a prescription, will have its own terms covering dispensing and delivery, and you will be given them at that point. Those documents govern your care and your medication. These terms govern this website.

Where a term in this document conflicts with the medical group’s consent, or with the terms of the pharmacy that dispenses to you, on a clinical or dispensing matter, theirs controls, because those are the parties performing that work.

SECTION 2

What LuneRx is, and what it is not.

LuneRx is a marketing and technology platform. That is the whole of our role, and it is worth stating in the negative as well as the positive.

LuneRx is not:

  • a pharmacy. LuneRx does not compound, stock, own, package, label, handle, dispense, or ship any medication, and it never takes possession of one;
  • a medical practice, a healthcare provider, or a clinician of any kind;
  • a party that prescribes, diagnoses, treats, practices medicine, or gives medical advice;
  • the employer of the licensed providers who review assessments, and it cannot direct, influence, or overrule a clinical decision;
  • a seller of medication. Nothing on this site is an offer to sell a drug, and no medication can be purchased on this website;
  • a party that decides who receives treatment.

What LuneRx does is build and operate this website, publish the educational and safety information on it, run the free eligibility check, connect the information you submit to an independent medical group, and answer non-clinical questions about the platform.

Consultations are conducted by independent, licensed healthcare providers engaged by Vital Link PLLC, who exercise their own independent clinical judgment. If a provider decides a prescription is appropriate, it is filled and shipped by a state-licensed partner pharmacy operating under state board of pharmacy oversight. Those are separate organizations with their own legal and professional obligations.

SECTION 3

No medical advice, and no provider-patient relationship with LuneRx.

Everything on this website — pages, articles, answers to common questions, safety information, and any email we send you — is general information. It is not medical advice, and it is not a substitute for the judgment of a licensed clinician who knows your health history.

Using this site, completing the eligibility check, or contacting support does not create a provider-patient relationship between you and LuneRx. No such relationship can exist, because LuneRx does not practice medicine. If you go on to consult a licensed provider, the clinical relationship is between you and that provider through the independent medical group.

Never disregard professional medical advice, or delay seeking it, because of something you read here. Do not start, stop, or change any medication you are taking based on this website. Talk to a licensed clinician first.

If you think you are having a medical emergency, call 911 or go to the nearest emergency room immediately. Do not wait for a message reply, and do not use this website to seek urgent help.

Health information you enter into the eligibility check is handled under our Privacy Policy. Once it reaches the independent medical group, it is also handled under that group’s own privacy practices and under the federal health privacy rules that apply to a healthcare provider. Which rules bind which party, and what agreements sit between them, is set out on our HIPAA Notice. Read it rather than assuming this website and a clinician’s office are governed the same way — they are not.

SECTION 4

Eligibility and your responsibilities.

To use the services described on this site you must:

  • be 18 years of age or older — the eligibility check asks for your date of birth and stops there if you are under 18, and nothing you entered is sent;
  • be a resident of the United States, and be physically located in a state where the independent licensed providers we work with hold a license and a state-licensed partner pharmacy is permitted to ship;
  • have the legal capacity to enter into this agreement;
  • submit only your own information, and only information that is accurate, current, and complete;
  • have access to a device and an internet connection good enough to complete the eligibility check and, if you go on to consult a provider, to take part in a telehealth visit. That equipment is yours to arrange and maintain, and any data, messaging, or carrier charges it incurs are yours to pay. Neither LuneRx nor the medical group is responsible for a consultation that fails because a connection dropped, a device was incompatible, or an email or text was filtered before it reached you.

Availability differs by state and can change. The current position is published on our States Served page.

Accurate answers are a safety matter, not a formality. A licensed provider decides whether treatment is appropriate using the health information you supply, and they cannot examine you in person. Information that is false, incomplete, or submitted on someone else’s behalf can lead to an unsafe decision. It may also result in a provider declining to prescribe, and in LuneRx suspending or ending your access to the platform.

This website does not currently offer user accounts, logins, or online checkout. If that changes, these terms will be updated before those features go live, and account-security responsibilities will be set out here.

SECTION 5

The eligibility check, and what a provider review decides.

The only call to action on this site is a free eligibility check, which takes about two minutes. It asks for your goal, your state, your date of birth, your height and weight, a short set of health-history questions, and how to reach you. Completing it is free, and it commits you to nothing.

The eligibility check is a request for evaluation. It is not an order, not a diagnosis, not a consultation, and not a prescription. The body-mass-index figure the site calculates from the height and weight you enter is a general screening number shown for your information only. It is not a diagnosis and it does not determine whether you qualify.

What happens next is a clinical decision made by someone other than us. An independent licensed provider reviews what you submitted and decides whether prescription treatment is appropriate for you. That decision belongs to the provider alone.

Submitting the eligibility check does not guarantee a consultation, a prescription, or any particular treatment. Some people will not be approved, and a provider declining to prescribe is the screening process working as intended. LuneRx does not guarantee any health outcome. No specific result should be expected from any treatment described on this site, and results differ from person to person.

SECTION 6

The preparations described on this site.

Every preparation described on this site is a compounded prescription preparation. Each is prepared by a state-licensed compounding pharmacy for one individual patient, against a prescription written by a licensed provider for that patient. None of them can be bought over the counter, and none of them is sold on this website.

The site currently describes four preparations:

  • Compounded semaglutide — a peptide GLP-1 receptor agonist, given as a weekly subcutaneous injection. This is the primary treatment the site describes.
  • Compounded tirzepatide — a peptide that acts at two receptors involved in appetite and blood-sugar regulation (GIP and GLP-1), also given as a weekly subcutaneous injection. It is an alternative a provider may consider, not a default.
  • Semaglutide troche — a sublingual lozenge that dissolves under the tongue. Systemic exposure by this route is lower than by injection, and it is not the same as any FDA-approved oral semaglutide product.
  • MIC+B12 injection — a lipotropic blend of methionine, inositol, and choline with vitamin B12 (cyanocobalamin). It is a supportive adjunct within a broader plan. It is not a GLP-1, it is not a peptide medication, and it is not a weight-loss medication on its own.

Which preparation, if any, is appropriate for you is a clinical decision for the reviewing provider, made with your full health history in view. Nothing on this site, including the order in which preparations are listed, is a recommendation of one over another.

Availability is not guaranteed and can change. What can actually be prepared depends on what the dispensing pharmacy, Logos RX, is licensed and equipped to compound, on ingredient availability, and on the rules in your state. A preparation described here may be unavailable to you, may be withdrawn, or may be replaced by another formulation at the pharmacy’s or the provider’s discretion.

Prescription required. Compounded medications are not approved or evaluated by the FDA for safety, effectiveness, or quality. A licensed provider will determine whether treatment is appropriate for you.

SECTION 7

What compounding is, and what it is not.

This section is the one to read twice, because compounded preparations are frequently misunderstood.

Compounded medications are prepared by a state-licensed compounding pharmacy for an individual patient pursuant to a licensed provider's prescription. They are not FDA-approved, and the FDA does not review compounded medications for safety, effectiveness, or quality before they are dispensed. Compounded medications are not the same as, and are not generic versions of, any FDA-approved medication.

Compounded is a description of how a preparation is made. It is not a claim about quality, strength, purity, gentleness, or how well something works. A compounded preparation has not been through the FDA review that an approved drug goes through, and there is no FDA finding of safety or effectiveness behind it.

Compounded semaglutide and compounded tirzepatide are not the same as, and are not generic versions of, any FDA-approved medication, including Ozempic®, Wegovy®, Rybelsus®, Mounjaro®, or Zepbound®. They are different preparations. Ozempic®, Wegovy®, and Rybelsus® are registered trademarks of Novo Nordisk A/S. Mounjaro® and Zepbound® are registered trademarks of Eli Lilly and Company. LuneRx and its partners are not affiliated with, sponsored by, or endorsed by those companies, and nothing on this site should be read as suggesting otherwise.

The compounding pharmacy is responsible for the preparation itself: for sourcing its active ingredients, for the standards it compounds to, for testing, for labeling, and for its licensure with the state boards that oversee it. LuneRx performs none of that work and makes no representation about it.

Prescriptions arranged through this platform are dispensed by Logos RX, a compounding pharmacy located at 7543 W. Waters Ave, Tampa, FL 33615, reachable at 855-564-6779, by fax at 813-886-2822, and at support@logosrx.com. Logos RX describes itself as a 503A compounding pharmacy operating sterile and non-sterile compounding labs, accredited by the National Association of Boards of Pharmacy, and compounding to USP 795 and USP 797 standards. It is a separate company from LuneRx. It, and not LuneRx, is responsible for everything described in the paragraph above.

Before certification, obtain the pharmacy’s registered legal entity name, confirmation that it holds current Florida licensure and non-resident licensure for every state listed on the States Served page, its NABP accreditation, whether it also operates a 503B outsourcing facility, and the potency and sterility testing it performs on finished preparations. License numbers are held on file rather than published on this site. A certification reviewer will ask for all of it, and will ask for evidence rather than the pharmacy’s own marketing copy.]

SECTION 8

Peptide medications.

Semaglutide and tirzepatide are peptides. Because peptides are sold irresponsibly elsewhere on the internet, it is worth being explicit about the terms on which they appear here.

  • Every peptide preparation described on this site is a prescription medication, available only after an independent licensed provider has reviewed your health information and written a prescription for you individually.
  • Nothing on this site is offered as a research chemical, as a "research use only" product, or as anything "not for human consumption". LuneRx does not advertise, list, link to, or facilitate access to peptides supplied on those terms, and does not work with suppliers who do.
  • No peptide is available in bulk, in unlabeled vials, as raw powder for self-reconstitution outside a pharmacy’s directions, or in any quantity beyond what a prescription specifies.
  • Peptides described here are prepared and dispensed only by a state-licensed pharmacy. LuneRx does not source, import, test, hold, or resell peptide ingredients or finished preparations.
  • Requests for a specific peptide, a specific dose, or a specific quantity are not orders. A provider prescribes what they judge appropriate, or declines.

Buying peptides from a source that does not require a prescription carries real and documented risks, including products of unknown identity and strength, contamination, incorrect or fraudulent labeling, and counterfeits. If you have obtained a peptide from any such source, tell the reviewing provider. It affects what is safe to prescribe.

[TO CONFIRM: whether any preparation offered through the platform contains an ingredient appearing on an FDA compounding risk list or is otherwise restricted, and whether any non-GLP-1 peptide is to be added to the platform. Any addition needs its own review before it is described on this site.]

SECTION 9

Prescriptions, dispensing, and refills.

A valid prescription from a licensed provider is required before any preparation described on this site can be dispensed. There is no route around that step, and LuneRx cannot create one.

The prescribing provider decides what to prescribe, at what strength, on what schedule, and for how long. Dose changes, titration, pauses, and stopping treatment are clinical decisions made by that provider. Do not change a dose on your own, and do not use a preparation prescribed for someone else.

The dispensing pharmacy independently verifies every prescription before it prepares anything, and a pharmacist may contact the prescriber with a clinical question, may decline to fill, or may be unable to fill for a reason of its own, including licensure, ingredient availability, or a professional judgment about the order.

Refills, where a prescription provides for them, are not automatic and are not a subscription to a product. They depend on the prescription remaining valid, on your keeping up with the check-ins the provider asks for, and on the provider continuing to judge treatment appropriate. Early refills are generally not permitted.

A prescription may be transferred to another pharmacy at your request, in accordance with pharmacy law. Contact the dispensing pharmacy about that; LuneRx cannot transfer a prescription.

If treatment stops for any reason — you cancel, a provider declines to continue, a pharmacy cannot fill, or services end in your state — you keep the right to obtain care elsewhere, and to ask the medical group for a copy of your records.

SECTION 10

Shipping, storage, and handling.

Medication is shipped by the state-licensed partner pharmacy that dispensed it, directly to you. LuneRx does not ship anything, does not select the carrier, and does not control delivery.

You are responsible for giving a correct, complete delivery address and for keeping it current with the pharmacy. Shipments are sent within the United States only, to a state where the pharmacy is permitted to ship. Do not ask for a shipment to be forwarded, re-shipped, or exported abroad. Carrying or sending a prescription medication out of the country may break the law where it arrives.

Some preparations are temperature-sensitive and are shipped under cold-chain conditions. Delivery timing therefore matters, and a package left unattended in heat or freezing conditions may be compromised.

  1. Plan to receive the package. Arrange delivery to somewhere it can be taken in promptly.
  2. Inspect it on arrival. Check the packaging, the cold pack if there is one, the label, the expiry date, and the appearance of the contents.
  3. Store it exactly as the label and the pharmacy’s instructions say — most commonly refrigerated, protected from light, and never frozen unless the label says so.
  4. Do not use a preparation that arrived warm when it should have been cold, that is discoloured or cloudy when it should be clear, that contains particles, that is past its beyond-use date, or whose label is damaged or missing. Contact the pharmacy first.
  5. Dispose of needles and syringes in an approved sharps container in line with your state’s rules. Never put them in household waste or recycling, and never reuse or share a needle.

Title to a dispensed medication, and the risk of loss or damage, will pass under the terms of Logos RX, the pharmacy that dispenses it, not under these terms. [TO CONFIRM: Logos RX shipping terms. The pharmacy is identified, but its shipping terms have not been obtained. Settle and reflect here the carrier, the cold-chain method, delivery-window commitments, signature requirements, the point at which title and risk of loss pass, and the process for a lost, delayed, stolen, or heat-damaged shipment. The refund policy page needs the same answers.]

SECTION 11

Returns, recalls, and product problems.

Dispensed prescription medication cannot be returned, resold, restocked, or reused once it has left the pharmacy. That is a requirement of pharmacy law and medication safety, not a commercial preference, and it applies even if a package is unopened.

If something is wrong with what arrives — the wrong preparation, the wrong strength, a damaged or leaking container, a missing or unreadable label, a broken cold chain, or anything that does not look right — stop, do not use it, and contact the dispensing pharmacy straight away. The pharmacy handles product complaints, replacements where they are warranted, and batch-level investigations, because it is the party that prepared and shipped the medication.

If a preparation is recalled or withdrawn, the pharmacy is responsible for notifying affected patients and for the recall process. Follow the instructions it gives you. Do not continue using a recalled preparation while you wait for a reply.

You can also report a problem or an adverse event directly to the FDA MedWatch program at fda.gov/safety/medwatch or by calling 1-800-FDA-1088. Reporting is worth doing even when the pharmacy is already handling it.

SECTION 12

Treatment risks you acknowledge.

GLP-1 medications are prescription treatments with a real mechanism, a real safety profile, and real contraindications. Some people should not take them at all. By using this site and submitting the eligibility check, you acknowledge the following.

  • Side effects are common, particularly while a dose is being adjusted — most often nausea, constipation, fatigue, and heartburn. Serious effects are uncommon but real, and include pancreatitis, gallbladder problems, allergic reactions, and vision changes in people with diabetic retinopathy.
  • Some histories rule these medications out, including a personal or family history of medullary thyroid carcinoma or MEN 2, a history of pancreatitis, pregnancy, breastfeeding or trying to conceive, and certain gastrointestinal, kidney, or liver conditions.
  • You will disclose your full health history, every medication and supplement you take, and any previous GLP-1 use, to the reviewing provider, and you will keep them updated if that changes.
  • You will follow the prescribing provider’s directions and the pharmacy’s labeling, will not exceed a prescribed dose, and will contact the provider before changing anything.
  • You will report side effects to the prescribing provider promptly, and will seek emergency care for anything severe rather than waiting for a reply.
  • No outcome is promised. Individual results vary, and medication is one part of a plan that also involves nutrition, movement, sleep, and follow-up.

SECTION 13

Email, text, and phone consent.

The eligibility check presents two consent checkboxes, and they do different things.

The first is required. By ticking it you confirm you have read and agree to these Terms and Conditions, the Privacy Policy, and the Telehealth Informed Consent, and that you understand LuneRx is not a pharmacy or a medical provider, that an independent licensed provider determines eligibility, and that a prescription is required for all medications. Without it the form cannot be submitted.

By submitting the eligibility check you also agree that LuneRx, and the independent medical group your information is routed to, may contact you by email, phone, or text about that submission and the next steps you asked for. These are service messages, not marketing.

The second checkbox is optional, and it is the marketing one. Ticking it means you agree to receive marketing calls and texts from LuneRx at the number you provided, including messages sent using automated technology. Consent is not a condition of any purchase and is not a condition of care or of being evaluated by a provider. You can complete the eligibility check without it.

Message and data rates may apply. Message frequency varies. [TO CONFIRM: message frequency disclosure and HELP keyword response, once the SMS platform is selected.]

  • To stop marketing texts, reply STOP to any message.
  • To stop marketing emails, use the unsubscribe link at the bottom of any marketing email.
  • To ask us to stop contacting you altogether, email support@lunerx.com.

Opting out of marketing does not stop service messages about a submission you made or a request you sent us, and it does not stop the independent medical group or the pharmacy from contacting you about your care or your order.

We record which version of this consent text you agreed to, and when, together with your submission, so that both sides have a record of what was actually shown.

This platform runs entirely online, so records reach you electronically. You agree that we may give you notices, disclosures, agreements, and other records by email, by text where you have given us a number, or by posting them on this website, and that an electronic record meets any legal requirement that such a communication be in writing. Ticking the required consent box on the eligibility check is an electronic signature and carries the same weight as a signature on paper.

To receive those records you need a working email address and a device able to open and store them. Tell us at support@lunerx.com if your email address changes, and use the same address to ask for a paper copy of a record or to withdraw your consent to electronic delivery. Because the platform has no paper alternative, withdrawing that consent means you can no longer use it.

SECTION 14

Conduct and prohibited uses.

You agree not to:

  • misrepresent who you are, your age, your location, or your health history, or submit another person’s information as your own;
  • seek medication for anyone other than yourself, or obtain it for onward supply to another person;
  • resell, share, transfer, trade, donate, or otherwise divert any medication obtained through a prescription, or offer any of it for sale online or anywhere else;
  • alter, remove, obscure, or reproduce a medication label, or repackage a dispensed preparation;
  • export a prescription medication, arrange for it to be forwarded outside the United States, or ship it to a state where the dispensing pharmacy is not permitted to ship;
  • attempt to obtain duplicate or overlapping prescriptions, from this platform and elsewhere, for the same class of medication without telling both prescribers;
  • use the site or any service for an unlawful purpose, or in a way that breaks state or federal law, including the laws that govern prescribing, dispensing, and the advertising of prescription drugs;
  • scrape, crawl, harvest, or use automated tools to collect content or data from the site, or attempt to bypass any technical measure that limits access;
  • attempt to gain unauthorized access to the site, its underlying systems, or any account, system, or data belonging to another user, the medical group, or a partner pharmacy;
  • interfere with the operation of the site, introduce malicious code, or place unreasonable load on it;
  • copy, reverse engineer, or create derivative works from the site or its software;
  • harass, threaten, or abuse our support team, a provider, or pharmacy staff.

We may suspend or end access to the platform, without notice, for anyone we reasonably believe is doing any of the above, and we may report unlawful conduct, including the diversion or resale of prescription medication, to the appropriate authorities and to the relevant state boards.

We are under no obligation to monitor use of this site, but we may. We may review what is submitted through the eligibility check and the contact form in order to operate the site, keep it secure, investigate a suspected breach of these terms, and comply with the law or a valid legal request, and we may refuse to transmit or may remove anything at our discretion. Our doing any of that does not make us responsible for what someone else submits, and nothing here is a promise that we will detect misuse.

SECTION 15

Intellectual property.

The content of this website — text, photography, graphics, page design, layout, the LuneRx name and logo, and the underlying software — is owned by The Piper Group or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, personal, non-exclusive, non-transferable, revocable license to view and use this site for your own personal, non-commercial purposes. That license ends automatically if you breach these terms.

You may not copy, reproduce, republish, distribute, publicly display, frame, or create derivative works from any part of the site without our prior written permission, and you may not remove or obscure any copyright or trademark notice.

Third-party names and marks that appear on this site, including the branded medications named in Section 7, belong to their respective owners. They are used only to describe and distinguish those products, and their appearance here does not imply any affiliation, sponsorship, or endorsement.

What you submit stays yours. So that we can operate the platform, you give LuneRx a limited, non-exclusive, royalty-free license to use, store, and transmit the information you send through the eligibility check and the contact form — but only for the purposes set out in our Privacy Policy, chiefly routing your submission to the independent medical group and replying to you. This is not a transfer of ownership, it does not permit us to sell your health information, and it ends when that information is deleted.

Feedback is treated differently and more broadly. If you send us a suggestion, an idea, or a comment about the platform, you agree we may use it for any purpose, without compensation and without any duty of confidentiality. Please do not send us anything you regard as confidential or expect to be paid for. This paragraph covers feedback about the product only — never your health information, which is governed by the Privacy Policy alone.

If you believe material on this site infringes your copyright, write to our designated agent at [PLACEHOLDER: designated DMCA agent name, postal address, and email] with enough detail to identify both the copyrighted work and the material you say infringes it, your contact details, a statement that you believe in good faith the use is not authorized, and a statement, made under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for them. We remove material that is properly the subject of such a notice and end access for repeat infringers.

SECTION 16

Third parties, partner pharmacies, and external links.

Delivering what this site describes involves organizations that are not LuneRx:

  • Vital Link PLLC, the independent medical group, and the licensed providers it engages, who conduct consultations and make every clinical decision;
  • state-licensed partner pharmacies, which compound, verify, dispense, label, and ship medication against a valid prescription;
  • service providers that operate the technology behind this site, including website hosting, the form processor that receives eligibility-check and contact-form submissions, and website analytics.

LuneRx does not control those organizations and is not responsible for their acts or omissions, including clinical decisions, prescribing, compounding, ingredient sourcing, testing, labeling, dispensing, packaging, shipping, or the professional services they provide. Claims about care or about medication should be raised with the party responsible for it. Our contact page explains which channel is which.

Nothing in these terms creates a partnership, joint venture, franchise, employment, or agency relationship between LuneRx and Vital Link PLLC, the providers it engages, or Logos RX. None of them is our agent and we are not theirs. None of them can enter into commitments on our behalf, and we cannot direct or overrule any of them — in particular LuneRx takes no part in, and has no power to influence or reverse, a clinical decision about whether to prescribe. Each party carries its own licensure, its own professional obligations, and its own liability for its own conduct.

[TO CONFIRM: the commercial arrangement between The Piper Group, Vital Link PLLC, and Logos RX. State plainly here how LuneRx is compensated, and confirm with counsel that the arrangement does not involve splitting professional fees with the providers or paying for referrals, since state fee-splitting, corporate-practice-of-medicine, and anti-kickback rules turn on exactly that, and a certification reviewer will ask. Until the arrangement is described, this page should not characterize it either way.]

This site links to external resources such as the FDA MedWatch program and the U.S. Department of Health and Human Services. We do not control those sites, we are not responsible for their content or their privacy practices, and a link is not an endorsement.

SECTION 17

Payment and billing.

Checking whether you may qualify is free. This website displays no prices, takes no payment, and has no checkout. Completing the eligibility check does not create a charge or an obligation to buy anything.

If an independent licensed provider determines that treatment may be appropriate, any costs are reviewed with you before a charge is made, and you decide at that point whether to go ahead. No medication is ever sold without a prescription, and no medication charge arises where no prescription is issued.

SECTION 18

Insurance and financial responsibility.

Everything described on this site is paid for directly by the person receiving it. Nothing here is billed to insurance, and that has consequences worth stating before you begin rather than after.

  • No commercial insurance is billed. Neither LuneRx, nor Vital Link PLLC, nor Logos RX submits claims to a health plan on your behalf, and none of them will bill your insurer for a consultation or for a medication.
  • No federal or state healthcare program is billed. Neither you nor any of those parties will submit a claim for anything obtained through this platform to Medicare, Medicaid, TRICARE, the Veterans Health Administration, or any other federal or state healthcare program, and you agree not to seek reimbursement from one.
  • Being enrolled in a government health program does not stop you using these services, but you would be using them on a self-pay basis, and what you spend will not count toward a deductible or an out-of-pocket maximum under that program.
  • You are responsible for the full cost of any consultation and of any medication a provider prescribes, and for the cost of any care you seek elsewhere — laboratory work, monitoring, or treatment for a side effect included.
  • Whether a health savings account or a flexible spending account can be used is a question for your plan administrator, not for LuneRx. We make no representation that any of these costs is an eligible expense.

Costs are reviewed with you before any charge is made, as described in Section 17, and cancellation is covered by our Refund and Cancellation Policy.

SECTION 19

Disclaimers and limitation of liability.

The site and the platform are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, LuneRx disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, timely, secure, or free of errors, or that any information on it is complete or current.

Because LuneRx does not provide medical or pharmacy services, LuneRx makes no warranty about, and accepts no responsibility for, the clinical judgment of any provider, the appropriateness of any treatment, or the compounding, ingredient sourcing, testing, quality, labeling, dispensing, storage, or shipping of any medication. Those responsibilities rest with the independent medical group and the state-licensed partner pharmacy.

To the fullest extent permitted by law, LuneRx and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or personal injury, arising out of or relating to your use of the site or the platform, whether the claim is based in contract, tort, or any other theory, and even if we were advised that such damages were possible.

To the fullest extent permitted by law, our total liability for all claims relating to the site or the platform is limited to [PLACEHOLDER: liability cap — attorney to set].

Some states do not allow the exclusion of certain warranties or the limitation of certain damages, so parts of this section may not apply to you. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence where the law does not permit it to be limited.

SECTION 20

Indemnification.

You agree to indemnify and hold harmless LuneRx and its officers, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of or relating to your use of the site, your breach of these terms, information you submitted that was false or incomplete, your misuse or diversion of any medication, or your violation of any law or of another person’s rights.

We may take over the defense of any matter subject to indemnification, at your expense, and you agree to cooperate with us if we do. You may not settle any such matter in a way that imposes an obligation on us without our written consent.

SECTION 21

Disputes and governing law.

If something has gone wrong, the fastest route is usually not a legal one. Please contact us first at support@lunerx.com so we can try to resolve it directly. Complaints about clinical care are forwarded to the independent medical group, and complaints about a medication or a shipment to the dispensing pharmacy.

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules.

LuneRx is based in Tampa, Florida, so the expected venue is the state or federal courts serving Hillsborough County, Florida, but that is for counsel to confirm rather than for this page to assert. Whether disputes go to binding arbitration or to court, the arbitration provider and rules, any class-action waiver and its opt-out mechanism, any jury-trial waiver, the small-claims carve-out, and any limitation period must all be drafted and reviewed before they appear here. A dispute-resolution clause that has not been reviewed is worse than none.]

This section governs disputes with LuneRx about this website and the platform. It does not govern disputes with the independent medical group or with the pharmacy that dispenses to you, including any claim about clinical care or about a dispensed medication. Those are covered by the agreements those parties make with you directly.

SECTION 22

Changes to the service and to these terms.

We may change, suspend, or discontinue any part of this website or the platform at any time, including the preparations described on it and the states where services are available. Availability depends on provider licensure, pharmacy shipping permissions, and regulatory change, none of which stand still.

We may also update these terms. When we make a material change we will update the effective date at the top of this page and, where appropriate, tell you by email or through the site. Continuing to use the site after a change takes effect means you accept the updated terms. If you do not accept them, stop using the site.

You may stop using the platform at any time. We may suspend or end your access to it if you breach these terms, if we are required to by law, or if we discontinue the service. Ending access to the platform does not end any prescription you hold or any relationship you have with the medical group or the pharmacy — take those up with them directly.

Sections that by their nature should survive — including Sections 11, 12, 15, 18, 19, 20, 21, and 23 — survive the end of this agreement.

SECTION 23

Contact and general terms.

If any provision of these terms is found unenforceable, that provision is limited or removed to the minimum extent necessary and the rest stays in force. Our not enforcing a provision is not a waiver of it. You may not assign this agreement without our consent; we may assign it in connection with a merger, acquisition, or sale of assets.

Notices to you are given by email to the address you gave us, by text to the number you gave us, or by posting them on this site, and count as received on the day they are sent or posted. Keeping your contact details current is therefore worth doing — a notice sent to an address you no longer read still counts as given. Legal notices to us must be in writing, to the email and mailing address above, and count as received only when they actually reach us.

Except where these terms say otherwise, this agreement creates no rights for anyone other than you and LuneRx. It is not written to benefit Vital Link PLLC, the providers it engages, or Logos RX. Each of those makes its own agreements with you and answers to you for its own work under those agreements, not under this one. [TO CONFIRM: whether counsel wants Vital Link PLLC and Logos RX named as third-party beneficiaries of the disclaimer, liability, and indemnity sections. Many platform agreements do exactly that; this one deliberately stops short, because Section 21 already routes disputes with those parties away from these terms and the two provisions would otherwise pull against each other. Counsel should settle which way it goes rather than leaving both readings open.]

These terms, together with our Privacy Policy, are the entire agreement between you and LuneRx about this website, and they replace any earlier version of them.
